These Terms of Service (“Terms”) form a binding agreement between you and Perkstacker LLC (“we,” “us,” or “our”) governing your use of the Perkstacker mobile application and website at perkstackerapp.app. By creating an account, subscribing, or otherwise using the Service, you agree to these Terms.
You must be at least 18 years old and legally able to enter into contracts in your jurisdiction to use the Service. By using Perkstacker, you represent that you meet these requirements.
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at admin@perkstackerapp.app if you suspect unauthorized use.
You may not create more than one free account per person to abuse trial promotions or referrals; doing so may result in termination.
Perkstacker offers 4 tiers: Bronze (free), Silver ($3.99/month or $39.99/year), Gold ($9.99/month or $99.99/year), and Business ($19.99/month/seat or $199.99/year/seat). Prices are in USD and may change with 30 days notice.
Payments are processed by Stripe. When you subscribe you authorize a one-time charge granting access for the paid period (30 days for monthly, 365 days for annual). No automatic renewal is charged unless expressly disclosed and consented to.
You will receive an emailed receipt via Stripe for each successful payment.
Eligible new users may activate a one-time 7-day free trial of the Gold tier. Trials are limited to one per person and one per email address; abuse detection may deny the trial.
At the end of the trial you automatically revert to Bronze unless you have purchased a paid subscription. No credit card is required for the trial.
You may cancel at any time from Profile → Manage subscription. Cancellation stops future renewals; you retain access to your paid tier until the end of the current paid period.
Refund eligibility, timing, and process are described in our Refund Policy at perkstackerapp.app/refund.
You may share your personal referral code with others. When a new user creates an account and applies your code, both you and the invitee receive 30 days of the Silver tier as a reward.
Referral rewards may not stack indefinitely; we reserve the right to cap total rewards to prevent abuse. Fraudulent referrals (self-referrals, bulk fake accounts) will be reversed and may result in account termination.
You agree not to:
You retain ownership of the content you add (loyalty cards, receipts, expense notes). You grant us a worldwide, royalty-free license to store, process, and display that content solely to operate the Service on your behalf.
You are responsible for the accuracy and legality of content you upload; do not upload content that infringes intellectual property or privacy rights of others.
The Service integrates with third-party providers (Stripe for payments, Anthropic Claude for AI, Foursquare for places, MongoDB for storage). Your use of those third parties is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
AI-generated tips, tax dashboards, per-diem lookups, and mileage reports are informational only. They are NOT professional tax, legal, or financial advice. You are solely responsible for the accuracy of your tax filings and financial decisions. Consult a licensed accountant or attorney before relying on any figure from the Service.
Perkstacker is a third-party tracker; we are not affiliated with, endorsed by, or sponsored by any loyalty program, restaurant, retailer, hotel, airline, or fuel-station brand mentioned in the app. Points balances, redemption thresholds, and reward availability are as reported by you or the third-party program and may not reflect real-time reality. Always verify at the source before making a purchase decision.
The Perkstacker name, logo, code, designs, and other proprietary content are owned by us and protected by copyright, trademark, and other laws. You may not use them without prior written permission.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, PERKSTACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to indemnify and hold harmless Perkstacker, its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or misuse of the Service.
You may terminate your account at any time from Profile → Delete account. We may suspend or terminate your account with or without notice if you violate these Terms, engage in fraud, or if required by law. Provisions that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) shall survive.
These Terms are governed by the laws of the State of Illinois without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Sangamon County, Illinois, and you consent to the personal jurisdiction of those courts.
You and Perkstacker each waive any right to a jury trial to the maximum extent permitted by law. This clause does not prevent either party from seeking injunctive relief for intellectual-property matters.
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
